Maine Widow Awarded $6.7 Million in Medical Malpractice Case

The widow of a man who died in 2005 after an ATV accident was awarded $6.7 million by a Maine jury in a medical malpractice lawsuit against Eastern Maine Medical Center in Bangor.  The man was flown to the center after the accident, and according to the lawsuit, the doctors failed to follow up on tests indicating internal bleeding, that ultimately led to the man’s death.

The man arrived at the hospital suffering from several broken ribs, among other injuries, and CT scans ordered by the emergency department physician indicated there was also internal bleeding. The doctors caring for the man failed to follow up on the internal bleeding by not issuing an order for X-rays to monitor the bleeding, according to the suit. Three days later, the internal bleeding caused one of the man’s lungs to collapse, and the lack of oxygen precipitated a massive fatal heart attack.

The jury found that Eastern Maine Medical Center, its doctors and nurses, and the lead physician were negligent in the man’s death.

The award most likely will be reduced due to a cap enacted by the Legislature, although the cap in place at the time of the man’s death will apply.

City of San Diego Pays $1.8 Million in Wrongful Death Case

The family of a motorcyclist who was killed in an April 2009 auto accident sued the city of San Diego for wrongful death for failing to install a traffic signal at the intersection in which the man died.  The City Council unanimously approved the settlement earlier this month, although they do not acknowledge any wrongdoing under the deal.

The accident occurred when the motorcycle was traveling northbound on Pacific Highway when a Toyota Corolla heading in the opposite direction turned left on Cedar Street in front of the cyclist. The cyclist was tried to veer out of the way, but struck the rear passenger side of the vehicle dying of traumatic head injuries.

The lawsuit claimed the accident was foreseeable and preventable.  The suit claimed, “This turn lane’s position combined with the position of the then existing traffic signals gave drivers the confusing illusion they had the right-of-way on a green signal to turn left onto Cedar Street.”

Car Accident Round-Up – PA Accident Claims Life of Actor

Pennsylvania Accident Leaves Actor Dead

A single car crash around 3am on Monday morning at the intersection of Route 322 and New Street in West Goshen Township, Pennsylvania, claimed the lives of actor Ryan Dunn and his passenger. Both of them died of injuries sustained in the accident.  While an investigation is ongoing, police indicated that Dunn was most likely speeding in his 2007 Porsche 911 GT3. The car, which was engulfed in flames after running off the road and ending up in the woods, was destroyed.

Drunk Driver in NC Leaves Two Motorcyclists Dead

A pickup driver charged with driving while impaired crossed the center line when traveling north on N.C. Highway 82 early Sunday morning, and struck a southbound motorcycle carrying a driver and passenger leaving both of them dead at the scene. The passenger of the motorcycle was a volunteer with Dunn Emergency Services.  The pickup driver was also charged with two counts of felony death by motor vehicle, driving left of center and careless and reckless driving. He was being held in the Harnett County jail Sunday under a $100,000 bond.

I-85 Accident Leaves One Dead, Four Injured in South Carolina

A Texas woman was charged Monday with driving her pickup truck too fast for conditions after crashing into the back of a car that was slowing due to a flat tire on I-85 outside Spartanburg, SC.  The pickup hit the car, carrying five people, from behind sending it into the concrete median causing the car to catch fire.  One woman in the car was pronounced dead at the scene, and the other four occupants were taken to the hospital with unspecified injuries.

RV Tire Blowout Causes Fatal Accident

Police continue to investigate a Monday evening accident on I-75 near Wesley Chapel, Florida that left one man dead and three others injured after an RV suffered a tire blowout and veered into another lane.  The RV forced a Jeep off the interstate where it hit two trees and overturned.  A passenger in the Jeep died at the scene.  Two others in the jeep suffered serious injuries and one other had minor injuries.  None of the seven occupants of the RV were injured.

Woman Sues Dentist for Pulling Too Many Teeth

A Durham woman has filed a lawsuit against a Durham dentist alleging medical malpractice and battery for pulling 24 teeth from her mouth instead of the 6 she agreed to have pulled.

In 2007, the 18-year-old woman went to Durham Family Dental Care to have four wisdom teeth and two molars pulled by Ilias Haralambakis, but when she woke up and the sedation medication had worn off, she found many more teeth had been pulled. 

She is left with six bottom teeth and only two top teeth.  She wears only her top dentures because the bottom ones don’t fit, and she is unable to eat certain foods.  She claims she can’t teach her young son how to brush his teeth because she has none herself.

The complaint states she has suffered “excruciating pain,” her jaw locks up on a regular basis, and she acquired a painful infection in her mouth following the extraction of the teeth.

Staples Center Sued Following Death of 2-Year-Old

The family of a 2-year-old who fell from a luxury box last year and died has filed suit against the owners of the Staples Center, Anschutz Entertainment Group, and the operator of the arena, L.A. Arena, Co.

The toddler fell at least 30 feet following a Lakers game last year.  The lawsuit alleges the barrier in front of the boxes was only 2 feet high and that the owners did not adequately warn patrons of the dangerous conditions.  It further alleges that the dangerous conditions were allowed to continue so the arena would make more money if fans had an unobstructed view of the games.

As the family was reviewing pictures they had taken, they found that the toddler somehow made his way over the barrier, fell at least 30 feet, and landed on a row of empty seats.  He died the next day at the hospital.

A Sunday morning crash on I-81 near Abingdon, Virginia has left a 23-year-old college student dead.  The driver of the 2005 Jeep Wrangler left the northbound lanes of the highway, struck several trees then overturned. The deceased was the only person involved in the single-vehicle accident

Fleeing Man Causes Fatal Accident in West Virginia

Deputies in Loudon County, Virginia attempted to pull over a speeding driver before he fled the scene and raced across the state line into West Virginia causing a multi-car accident leaving one person dead and five others injured, including the fleeing driver.  The DC man was driving a stolen Toyota 4Runner on Wednesday morning around 3am when he crossed into oncoming traffic and sideswiped a car carrying three people, then careened sideways and struck a van head-on that was carrying two.  All of those involved in the accident were taken to the hospital with non-specified injuries.  The man fleeing from the police was charged with speeding to elude, possession of a stolen vehicle and driving on a suspended license.

California Pedestrian Dies When Struck by Car

A pedestrian running across a San Marcos, California street on Wednesday night was struck by a car heading east.  The man died of his injuries at Palomar Medical Center.  The area of the road on West San Marcos Boulevard where the man was struck was very busy at the time of the accident.  The driver stopped to help the victim, and has not been charged in the incident.

Reckless Pennsylvania Driver Takes Aim at Pedestrians

An Erie, Pennsylvania man was put in jail Thursday morning after he was charged with trying to run down pedestrians on Erie’s east side.  The man was driving his 2000 Chevrolet Blazer at a high speed down the sidewalk around 7:30pm on Wednesday night.  He was charged with aggravated assault, recklessly endangering, terroristic threats, disorderly conduct, reckless driving and driving under the influence.  No one was injured in the incident.

Woman Sues Carnival After Trailer Hits Her Car

A lawsuit has been filed by an East Texas woman against Austin A. McWhorter, Lon McWhorter and Mac’s Carnival and Attractions after a trailer carrying carnival equipment detached from its Ford truck and hit her vehicle on May 14, 2009.

The woman was a passenger in a 2008 Dodge Ram when the incident happened.  The lawsuit alleges the defendants were negligent in failing to use safety chains, failing to control the vehicle and for entrusting the truck to an unlicensed, incompetent or reckless driver, among other things.

Damages for medical expenses, physical pain and suffering, mental anguish, disfigurement, loss of earning capacity, interest and court costs are being sought by the plaintiff.

Personal Injury Filed Against City Following Wheelchair Accident

The city of Sheboygan, WI is being sued by Ronald Behr following an incident on May 2, 2009, when his wheelchair tipped on a ramp between the street and sidewalk.  Behr claims he suffered severe and permanent injuries from his fall.

According to the complaint, a piece of patched asphalt broke loose, causing his wheelchair to dig into the pavement, pitch forward and throw him onto the ground.  He claims the city was aware of the danger of the carelessly patched asphalt which was done in a “careless and negligent manner.”  The lawsuit seeks compensatory damages and reimbursement of attorney fees.

The city denies receiving notice of the defect in the ramp.

Mother Files Wrongful Death Lawsuit Against YAZ Following Daughter’s Death

An 18-year-old college student died of cardiac arrest in September after she took YAZ to treat her acne.  The student’s mother has filed a wrongful death lawsuit against Bayer, the maker of YAZ, also known as Yasmin or Ocella.

The lawsuit alleges YAZ is a “dangerous prescription drug sold without adequate warnings about the risks of serious and fatal injuries.” 

Following two studies, the British Medical Journal last month published findings that drugs containing the hormone drospirenone were 2-3 times more likely to increase the risk of serious blood clots than earlier-generations of oral contraceptives.  YAZ contains drospirenone.

While Bayer claims this side effect is rare, the YAZ website does warn against the increased risks of blood clots, stoke, and heart attack.  In 2008, the U.S. Food and Drug Administration sent Bayer Healthcare Pharmaceuticals, Inc. a warning letter citing the company for running two misleading television ads which overstated its benefits and minimized serious side effects.

Kent State University Student Killed In Traffic Crash – Family Files Wrongful Death

The family of a 19-year-old Kent State student killed when her car was struck by a cargo van on March 21 has filed a wrongful death lawsuit in Delaware against the driver of the van and his employer.

According to the Ohio Highway Patrol, the driver of a Dara Toy Company 2006 Chevrolet Express cargo van became distracted while reaching for his cell phone charger and lost control of his vehicle.  The van crossed the highway median, all three southbound lanes and the rest area exit ramp before hitting the 2001 Pontiac Grand Am driven by Carli Woodruff as she was leaving the rest area.

Woodruff, a native of Loveland and an intervention specialist major, died at Grant Medical Center in Columbus.
