$10 Million Awarded for Injuries in Ambulance Birth

Fox News reports a Florida jury has awarded $10 million to a woman who sued an ambulance service for injuries her son received in 2003.

EVAC Ambulance service was sued for negligence, and the plaintiff alleged the paramedics caused her son’s birth injury which resulted in his having cerebral palsy. The mother was only six months pregnant when she gave birth on the way to the hospital. Her son had trouble breathing and the paramedics performed CPR, but the baby still suffered from a lack of oxygen to his brain, causing life long disabilities.

Others named in the lawsuit previously settled for $1.4 million.

$2.25 Million to Be Paid By Officer and Bar In Deadly Car Crash

A police officer and the bar which served her will pay a total of $2.255 million for the wrongful death of four and the injuries to another man, reports St. Louis Today.

The lawsuit claimed the police officer had consumed a “high quantity” of alcohol at O’Leary’s Restaurant and Bar and the employees at the bar knew she was intoxicated and did not stop her from driving or call her a cab. Despite her slurred speech and unsteady walk, the bar continued to serve her alcohol. After leaving the bar, the officer crashed her car into a Honda with five students from India.

The driver of the car hit by the police officer suffered a head injury, a fractured rib, liver trauma, lung contusion, and contusions to the skull. His four passengers were killed, according to the article.

Family Accepts $5.2 Million After Caesarean Section Death

The family of a 32-year-old woman who died following childbirth in 2007 has accepted $5.2 million from two doctors and the Albany Medical Center Hospital, reports the Albany Times Union. The settlement also includes mandated changes in procedures at the hospital.

After a normal and healthy pregnancy, the mother bled to death following a Caesarean section despite several calls to her primary obstetrician stating she was bleeding internally. After the third call, the doctor came to operate on the patient, but by then she had lost too much blood, the newspaper reported.

Instead of going to trial in August, the family accepted the settlement because they could not have won the non-monetary stipulations in a trial. These stipulations require the hospital to take specific steps to enhance patient safety.

$3.8 Million Paid To Man Injured In Boating Accident

The Dallas Morning News reports a federal jury has ordered a boat manufacturer to pay $3.8 million to a man who was injured in a boating accident on Lake Austin.

An 18-year-old man lost part of his leg while he was wakeboarding on July 4, 2007. The lawsuit alleged the boat, made by the Brunswick Corp., did not have proper safety devices in place to prevent such an accident. The suit claimed the young man’s leg became tangled in the propeller because the boat did not have guards and covers to protect him from becoming stuck in the propeller.

The company is considering an appeal.

Pfizer, Inc. Settles Wrongful Death Lawsuit Involving Neurontin

The Wall Street Journal reports Pfizer Inc., maker of the anti-seizure drug Neurontin, has agreed to pay a widow an undisclosed amount following her husband’s death in 2002. The woman claimed her husband’s suicide was a result of his use of Neurontin.

Her lawsuit alleged Pfizer was aware the drug was associated with the risk of suicide, but the company failed to properly warn the public and that Pfizer promoted the use of the drug for the effects of paralysis (as in her husband’s case) even though it was not approved by U.S. regulators.

Pfizer has had years of legal problems resulting from their marketing of Neurontin. In 2004, Pfizer pleaded guilty to a criminal charge and agreed to pay $430 million to settle investigations by the government over its promotion of Neurontin. Just a few weeks ago, a federal jury concluded Pfizer violated other laws and awarded damages of $47 million – which will be automatically tripled under the law. Pfizer plans to appeal this judgment.

According to the Associated Press, a jury has awarded parents $1.6 million in their medical malpractice lawsuit filed following their son’s death on an Eastern Connecticut State University basketball court.

The 22-year-old senior collapsed during a basketball game in 2005. The parents alleged the doctor who examined him in 2001 should have found the congenital heart defect known as hypertrophic cardiomyopathy. The doctor found him to be in excellent health and signed his college medical form.

The doctor scheduled an echocardiogram for the young man after the examination, but he did not show up for the test.

Oregon Bar Owners Will Pay At Least $1.3 Million In Drunk-Driving Death

The former owners of a restaurant in Gresham, Oregon will pay $1.3 million after being accused of serving too much alcohol to a convicted drunk driver who killed two young women reports KATU.com. The judge could more than double that amount.

Although the Golden Star Restaurant is now under different ownership, the parents of the young women sued the former owners accusing them of knowingly over-serving the driver and then allowing her to drive.

The bar had a history of over-serving its patrons and had received several written warnings from the Gresham police, an Oregon Liquor Control Commission fine and dozens of patron DUI arrests, according to news reports.

The two young women were celebrating the 21st birthday of one of the girls when their car was hit head-on by the drunk driver going the wrong way on the highway. Neither girl had alcohol in her system.
