$2.45 Million Paid By City of Inglewood, California Following Police Shooting

The Daily Breeze reports the city of Inglewood has agreed to pay $2.45 million to the families of three men who were shot by police on May 11, 2008.

The lawsuit was filed in February of 2009 on behalf of one man who was killed, and the other two men who were injured, when police opened fire on the car carrying the three men. The police claimed they heard gunshots shortly before firing on the car, but no weapons were found in the car. The young men had done nothing wrong.

This and other shootings by the Inglewood police resulted in changes within the department and retraining of the entire police force.

$33 Million Awarded In Deadly Accident Due To Faulty Tires

Tire Review reports an Iowa jury has ruled against Cooper Tire & Rubber Co. in a deadly rollover crash in 2007 and awarded seven passengers $33 million.

In the lawsuit, the plaintiffs alleged a manufacturing flaw in the tires caused the tread separation and the driver to lose control of the vehicle. The 1997 Plymouth Grand Voyager minivan carrying the passengers rolled over, killing one passenger, paralyzing another, and injuring the other five.

Cooper denies the tires were at fault and is expected to appeal the verdict.

$33 Million Award Against Walgreens Upheld In Woman’s Death

The Ledger of Lakeland, Florida reports an appeals court has upheld a lower court’s award of $33.3 million to a husband and three of his children in their wrongful death lawsuit against Walgreens. Their 46-year-old wife and mother died in 2007 after Walgreen’s pharmacy mistakenly gave her 10 times the prescribed dosage for a blood thinner to treat breast cancer.

Diagnosed in 2002 with breast cancer, she was given an 88 percent chance to recover with the proper treatment. Part of the treatment was a prescription for Warfarin. At Walgreens, an inexperienced pharmacy technician gave the woman 10 milligram tablets instead of the prescribed 1 milligram tablets.

After several weeks of taking the medication, the overdose led to a brain hemorrhage and her being paralyzed, capable of communicating only by blinking her eyes. After a year of hospitalization, the woman was too weak to continue treatment for cancer. Her cancer spread and she died in 2007.

Woman Seeks $300,000 for Wrong Implants

The Associated Press reports an Ohio woman is suing her Pennsylvania plastic surgeon for $300,000 after she used the wrong breast implants.

According to the patient, even though she had chosen silicone implants on her doctor’s advice, saline implants were used instead because they were the only kind the surgeon’s office had in stock at the time of the surgery. After realizing the mistake, the doctor consulted the patient’s fiance and he told her to continue with the surgery even though he did not have the power to make the decision.

The lawsuit claims the doctor committed medical battery, medical malpractice, intentional infliction of emotional distress and false imprisonment for keeping her under anesthesia longer than necessary while trying to correct the mistake.

$1 Million Settlement Reached In Man’s Wrongful Death

The family of a 27-year-old man whose unlawful death was caused by police in Clackamas County, Oregon, has reached a $1 million settlement with the county, reports the Gresham News.

The family had separately reached a $1 million settlement with the city of Sandy and a former police officer.

In s lawsuit filed in September 2006, the family of Fouad Kaady alleged the police violated Kaady’s civil rights, used excessive force, then carried out an unconstitutional arrest, causing a wrongful death.

After rear-ending multiple cars and then wrecking the car he was driving, Kaady was found naked, burned, and bleeding when officers confronted him. Reporting him to be combative, officers attempted to subdue him with 50,000 volts from a stun gun. Claiming they still felt threatened by Kaady, the officers then shot him seven times, killing him.

A gas can Kaady was transporting caught fire, causing the crash of his car. Head injuries suffered in the crash and the pain from the burns may have caused Kaady’s erratic behavior, the newspaper reported.

Family Awarded $3 Million In Medical Malpractice Death

The Washington Post reports a jury has awarded $3 million to the family of a man who died after being misdiagnosed as having a hiatal hernia.

After barbecuing a steak and taking a bite, a 52-year-old man went to the Inova HealthPlex at Franconia-Springfield, Virginia, on July 6, 2006, with chest pains and complaining of trouble swallowing. After X-rays, EKG, and a CT scan of his chest, the radiologist’s notes show he thought the patient was suffering from “a large hiatal hernia.”

After being treated with oral medications with no success, the man was taken to Inova Fairfax Hospital where he continued to be treated with oral medications for his severe chest pain. The next day, a surgeon found the man had a perforated esophagus and ordered he be prepared for immediate surgery.

After suffering from the perforated esophagus for over 24 hours, he was severely weakened and went into cardiac arrest as he was being prepped for surgery, suffered irreparable brain damage and died July 17, 2006.

The widow filed a wrongful death lawsuit against the radiologist, the Association of Alexandria Radiologists and Fairfax Anesthesiology. Fairfax Anesthesiology settled out of court for $600,000. Due to a state cap on medical malpractice, the jury award was lowered to $1.25 million.

Florida Woman Awarded $1 Million For Faulty Handrail Injuries

A Fort Pierce jury awarded a woman more than $1 million for injuries sustained in a fall from faulty handrails that her landlord failed to fix.

The 32-year-old woman complained about the handrails when she moved into her apartment and was told they would be fixed. The landlord continued to receive numerous complaints from tenants and the property manager about the loose handrails.

In 2007, the woman slipped on her apartment landing, grabbed the handrail, which gave way, causing her to fall down four steps. She injured her neck and back, has had three surgeries, and had medical bills totaling almost $200,000.
