Paralyzed Woman Wins $23.4 Million From Ford Motor Company

ABC News reports a woman has been awarded $23.4 million by a California jury against Ford Motor Company following a 2007 accident which left her a quadriplegic.

The woman lost control of her Ford Explorer when the tread separated from her rear tire causing her car to roll three times down an embankment. She was left with both of her legs and most of her body paralyzed.

The lawsuit alleged flaws in the 1997 Explorer’s design caused it to lose control when the tire treads separated. Ford argued the accident was caused by worn-out tires.

The jury returned a unanimous verdict for the plaintiff.

Man Files Malpractice Lawsuit For Undiagnosed Cancer

A West Virginia man is suing Dr. Jonathan M. Zuniga and Kidney Associates for medical malpractice for failing to diagnose his cancer, reports The West Virginia Record.

From September 2002 to January 2008, he visited the clinic at least 20 times seeking medical care and treatment, according to the article. Due to his unresolved medical issues, on February 7, 2008, he saw another physician and was diagnosed with cancer of the bladder, the newspaper reported.

The lawsuit alleges the defendants were negligent because they failed to diagnose the man’s cancer, perform tests to determine cancer and fail to notice significant changes in his blood tests. As a result, he claims he has suffered physical and personal damages that would not have occurred if he had been diagnosed earlier.

$23.2 Million Awarded In Birth Injury

The West Central Tribune reports a Kandiyohi County (Minnesota) jury has found Rice Memorial Hospital and Affiliated Community Medical Centers negligent, and awarded $23.2 million to a Paynesville family and their severely handicapped daughter.

Deprived of oxygen during her birth, the girl suffers from spastic quadriplegic cerebral palsy, cortical impairment, neurological difficulties and seizures. Even though the jury did find for the defendants on the issue that the mother was informed of the risks of inducing labor and of vaginal delivery, they found the Medical Centers 80% accountable and 20% to the city-owned hospital.

The award includes $1.7 million for past health care expenses, $10 million for future health care expenses, $10 million for past and future pain, disability and emotional distress, and $1.5 million for loss of earning capacity.

Texas Family Files Wrongful Death Suit Against Toyota

KTRK in Houston reports the husband of a woman killed in a 2009 crash when the gas pedal of her Toyota Corolla malfunctioned is suing the automaker. The suit claims Toyota knew there was a problem, but did not act quickly enough to fix it.

In December, the wife and mother of two was killed instantly when her car raced through a stop sign and crashed into a concrete wall. Her model car later appeared on Toyota’s recall list to fix the problems with the accelerators.

The lawsuit against Toyota, the gas pedal manufacturer, and the local Toyota dealership alleges gross negligence claiming the defective pedal existed at the time the car left the manufacturer.

University of Pittsburgh Medical Center Sued Following Liver Transplant

Two brothers have filed separate lawsuits against the University of Pittsburgh Medical Center (UPMC) alleging they were not fully informed about the risks of a live-donor liver transplant. Since the surgery, they both have suffered complications, reports USA Today.

In 2007, the 43-year-old brother from the state of Washington donated part of his liver to his 45-year-old brother from California who suffered from liver disease. Each lawsuit claims the medical center and the former chief of transplantation made the live-donor surgery seem safer than it was.

The lawsuits cite results from studies published by the Pittsburgh Tribune-Review which showed 66 percent of the 121 liver live-donor transplants at UPMC from 2003 to 2006 resulted in major complications.

UPHC has declined comment.

Hospital To Pay $1.55 Million In Woman’s Death

Hartford Hospital will pay $1.55 million to the family of a woman who died in their emergency room, reports Connecticut’s Eyewitness News.

In March of 2004, a wife and mother sought medical help at the emergency room of Hartford Hospital, complaining of chest pain, vomiting and diarrhea. Doctors discharged her and told her she was fine and could go home.

She insisted on seeing another doctor and waited to see a cardiologist. She was found unconscious and unresponsive seven hours later when doctors finally checked on her.

She leaves behind a husband and two sons under the age of 12.

Parents File Lawsuit After Deadly Connecticut School Bus Accident

The parents of a teenage boy have filed suit against Autumn Transportation following a crash that injured their son and caused emotional turmoil when his friend was killed in the crash, reports the Connecticut News. The parents are suing on behalf of their son according to Connecticut law since the boy is a minor.

The bus went off the highway after it collided with a Volvo station wagon. The suit alleges the bus company allowed a driver who did not have proper training and licensing to drive the school bus, and further claims the company does not adequately supervise or train its drivers. The bus driver’s license has since been suspended by the Department of Motor Vehicles.

Also named in the suit are the bus driver and the teen driver of the Volvo for failing to take necessary precautions to avoid an accident.
