$1.7 Million Awarded In Pedestrian’s Death
A jury has awarded $1.7 million to the estate of a Birmingham Alabama pedestrian who was killed after being hit by a car driven by a former Alabama Power Company president, reports the Montgomery Adviser.
The 50-year-old man, employed by Southern Research Institute was crossing from one building to another when he was hit by the 82-year-old driver on February 11, 2009. The driver suffers from macular degeneration which causes impaired vision, yet still drives.

Unneeded Medical Procedures Performed At Maryland Hospital
The Baltimore Sun reports hundreds of heart patients from St. Joseph Medical Center in Towson, Maryland may have received unnecessary coronary implants. St. Joseph medical Center calls itself the busiest heart catheterization center in Maryland and is thought of as one of the primary cardiac care facilities in the area.
At least 369 patients have received letters informing them they may have received expensive and potentially dangerous coronary stents they did not need. At the time of their surgery the patients were told they needed the stent to open an artery which had severe blockage. They have since learned their blockage was only minor.
Dr. Mark Midei is the only doctor implicated in the hospital investigation so far. He allegedly told patients they had up to a 90 percent blockage, when in fact they had only a 10 percent blockage. In other patients, he placed two stents when only one was necessary.
Patients not only underwent dangerous surgery, they have been on blood-thinning drugs and have suffered the psychological effect of believing they have heart disease.

$1.5 Million Paid In Cell Phone-Caused Vehicle Crash
The Palo Alto Daily News reports the city of Palo Alto will pay $1.5 million to a man injured in a vehicle crash in 2006. The victim alleged a city worker failed to stop for a red light because he was reaching for his cell phone, resulting in a rear-end collision which left the plaintiff with debilitating spinal injuries. The victim had asked for more than $5 million from Palo Alto.
This is the largest payout for the city for a personal injury claim in recent history. The driver of the city vehicle is no longer employed by the city.

$9.5 Million Awarded in Cruise Ship Slip-and-Fall
Miami-Dade Circuit Court jury has awarded a British fitness instructor $9.5 million for injuries suffered when he slipped and fell on the wet floor of a spa on Norwegian Cruise Line’s Norwegian Crown reports the Miami Herald.
The 42-year-old man alleged he sustained a back injury in the 2006 fall and as a result became incontinent and impotent. The jury award will cover damages for economic losses, medical expenses, and past and future pain and suffering.
The defendant who is the operator of the spa strongly believes it is not responsible for the injuries and has filed papers seeking a new trial or a reduction of the jury award. The Miami based Norwegian Cruise Line settled out of court.

$7 Million Awarded To Woman Hit By Metro Van
The Seattle Times reports King County has agreed to pay what is believed to be the largest amount the county has ever paid a single plaintiff – $7 million to a woman hit by Metro van.
In November 2007, the woman was riding her Vespa scooter to work as an operating room nurse when she was struck by the Metro van. The driver failed to yield the right of way at a stop sign.
The impact with the van caused the woman to be thrown 40 feet, suffer severe internal injuries and compound leg fractures. She was in a coma for several days following the accident and has not been able to return to work.

New Antipsychotic Drugs Increase Other Health Risks
Reuters reports the “second-generation” antipsychotic drugs including Zyprexa, Risperdal, and Abilify are known to significantly increase the risk for diabetes and heart disease by increasing blood sugar and cholesterol levels. These drugs were developed because the older drugs had significant side effects, yet these newer drugs are known to cause health risks as well, the article reports.
Patients taking these newer antipsychotic drugs are supposed to have their blood sugar and cholesterol levels checked on a regular basis, but studies show that less than one-third of all patients have these tests done. Government warnings and recommendations did not increase the screening rates.
While the patients may not be heeding the warnings, new prescriptions for these drugs have declined as physicians proactively work to curb drug-associated diabetes and heart-related risk. Doctors are prescribing drugs which carry a lower risk of side effects, the article stated.

$1.3 Million Paid In Mental Hospital Injury
Pierce County, Washington has agreed to pay $1.3 million in a settlement over injuries incurred when a mentally disturbed patient tried to escape, reports The Seattle Times.
In 2004, a 27-year-old male patient attempted to escape through a window of a county-owned mental hospital. He suffered multiple fractures when he climbed out of a fifth floor window and tried to jump about 20 feet to a fire escape landing.
The lawsuit brought against the Puget Sound Hospital by the patient and his family alleged he was not properly monitored by the staff. The hospital is now closed.
