$11.1 Million Awarded To Family Of Nine-Year-Old In Medical Malpractice Lawsuit

A Florida jury has awarded $11.1 million to the family of a 9-year-old boy in a medical malpractice case filed against All Children’s Hospital, reports the St. Petersburg Times.

In August 2000, the boy — then 3 months old — was taken to the hospital after being sick for days with vomiting and diarrhea. After about 4 hours, the mother was told he was fine and she could take him home. The next morning, he was rushed back to All Children’s Hospital when he had trouble breathing. The lawsuit alleged the hospital and the medical staff did not properly check the child for dehydration on the first visit, causing him to suffer from irreversible brain damage.

Jury Awards $893,684 Over 2001 Birth Injury

The Janesville Gazette reports $893,684 has been awarded to the parents of a baby boy who suffered permanent injury to his shoulder during his birth in 2001.

The parents sued Janesville’s Mercy Hospital, Mercy Women’s Health Center, Mercy Clinic West and two doctors, claiming they were negligent in the way they handled the mother’s labor and the birth of her son.

Among other things, the lawsuit alleged the doctors should have advised the parents of the risks of a vaginal delivery and that it could be hazardous to the infant. The lawsuit alleges the doctors did not properly dislodge the baby’s shoulder when it got stuck during delivery, causing the nerves to stretch, causing permanent damage. The boy, now 8-years-old, has limited strength, dexterity and motion in his shoulder.

Phoenix To Pay Family $250K After Airport Death

The city of Phoenix has offered a $250,000 settlement to the three young children of a woman who strangled herself two years ago while in police custody at the Sky Harbor International Airport, reports KPHO News.

The city and police deny any wrongdoing on their part and offered the settlement because it would cost three times that amount if the case went to trial. The original amount sought by the children for negligence was $8 million.

The 45-year-old woman was drunk and unruly after missing her flight to Tucson where she was to attend a substance-abuse rehab clinic, according to the news report. The police arrested her and put her in a holding cell where she accidentally strangled herself while being chained to a bench.

Alleged Hospital Error Using Fentanyl Patch Fatal To Autistic Teen

A wrongful death lawsuit alleges a 15-year-old Autistic boy died in March when he was given a Fentanyl patch to alleviate his pain from a routine tooth extraction, reports Seattlepi.com.

Seattle Children’s Hospital sent Michael home with his mother on March 9, following the extraction, with the fentanyl patch for pain, according to a civil suit filed earlier this month in Washington’s King County Superior Court. Family members found him unresponsive the next morning and paramedics were unable to revive him – he was pronounced dead at his home.

The medical examiner report states the boy died from a drug overdose caused by the fentanyl patch, which is usually used for patients with chronic pain such as cancer patients, the newspaper reports.

Children’s Medical Director has admitted the hospital staff erred when if prescribed the fentanyl to Michael, according to the article. The hospital now has a system in place to prevent such tragedies, which it did not have at the time Michael was given the patch.

The FDA has warned against the misuse of the patch system since 2005 and in a recent public health advisory warned against prescribing the patch in situations identical to Michael’s, the article stated.

The civil lawsuit against the hospital was filed by Michael’s mother.

$3.7 Million Awarded To Family After Farm Worker’s Death

The Green Bay Press Gazette reports a Brown County, Wisconsin jury has awarded the family of a farm worker $3.7 million in their medical malpractice lawsuit.

The worker died after contracting a fungal infection called blastomycosis. On two separate occasions in December of 2003 the man sought medical treatment at the Bellin Family Medical Facility. The physician assistants misdiagnosed him as having pneumonia without running basic diagnostic tests, including x-rays. In late December, he was admitted to another hospital where he was correctly diagnosed, but it was too late to save his life.

The jury found Bellin Health System and Dr. Peri Aldrich, who oversees the physician assistants, negligent and awarded his wife and two young children $3.7 million.
