Health Concerns Surround Oral Contraceptive Drugs Yaz and Yasmine
The New York Times reports that Bayer HealthCare’s two top selling oral contraceptives, Yaz and Yasmine, have been surrounded by health concerns from both the health and legal community.
Yaz is the top selling birth control pill in the United States with less estrogen than its sister drug, Yasmine. This success is due in part to Bayer’s multimillion dollar as campaigns promoting the drug as a treatment for acne and severe premenstrual depression.
Some researchers say the drugs put women at higher risk for blood clots, strokes and other health problems than some other birth control pills the article states, while a Bayer-financed European study found the risks were comparable to those of older birth control pills. However, two studies on Danish and Dutch women, found a higher risk of blood clots for women taking the newer form of birth control pill.
The FDA has already asked Bayer to correct its television ads and has cited the company for not following proper quality control procedures at one of its plants.
According to Bayer, 74 lawsuits have been filed by women claiming they developed health problems after taking Yaz or Yasmine.
A study to identify blood clot incidents, stroke, and death among those using Yasmin and other oral contraceptives is being done by the FDA while Bayer is conducting its own post-market study.

Wrongful Death Lawsuit Filed in Texas I-35 Truck Accident Deaths
The sole survivor of an SUV struck by an 18-wheeler in a construction area of Texas I-35 has filed a wrongful death lawsuit. Named in the suit are her 13-year-old son and her 63-year-old father who both died in the accident which occurred over the 4th of July weekend.
The woman’s lawsuit was filed against the truck driver, the driver’s company, the construction company, and the Texas Department of Transportation (TXDOT.) Her SUV had slowed down for traffic in a construction zone where the highway narrowed to one lane when they were hit by the tractor trailer.
The lawsuit claims TXDOT did not have adequate safety controls in place which made the accident possible. After spending five days in ICU, the survivor is still recovering from her injuries.
Since the July 4th accident, three more people have been killed by another 18-wheeler in the same construction area.

Failure to Advise Woman of Mammogram Results in $3 Million Settlement
The family of a 47-year-old woman has accepted a $3 million settlement against University Diagnostic Medical Imaging and two Bronx doctors for not notifying her of her mammogram results. Her mammograms showed possible breast cancer.
The technician, who suspected breast cancer during the woman’s routine mammograms in 2001 and 2002, recommended an MRI and sent the results to her doctor, Dr. Karim. The results were never given to the patient and no follow up tests were conducted.
In 2004, when she found a lump in her breast, it was too late. The cancer had spread to both breasts and her liver. She died in March 2007.

City Liable In Meteorologist’s Personal Injury Case
A Hinds County Circuit Court judge has ruled in favor of a Mississippi meteorologist and his wife in their lawsuit against the city of Jackson for injuries suffered in a 2006 accident reports WLBT in Jackson. The total award was close to $2 million.
The couple suffered multiple broken bones and internal injuries when their car was hit by a car being chased by police, according to the news report. Judge Swan Yerger ruled the police officer acted with reckless disregard during the chase and found the City of Jackson was 40 percent responsible for the accident. The driver of the other car was found to be 60 percent responsible.

Cedars-Sinai To Pay $7.3 Million In Negligence Lawsuit
A $7.3 million award has been returned by a Los Angeles jury in a lawsuit alleging Cedars-Sinai Medical Center was negligent, reports the Enquirer-Herald.
The lawsuit was filed in 2005 by the parents of a baby who was misdiagnosed by doctors at Cedars-Sinai Medical Center. The lawsuit claimed the doctors in the hospital’s neonatal intensive care unit failed to quickly diagnose and treat the baby for meningitis. As a result of the delay in treatment, the child suffered irreversible brain damage.

Family of Dead Musician Sues Makers of Chantix
The parents of Dallas musician Carter Albrecht have filed a federal lawsuit over their son’s 2007 death. They are claiming Pfizer did not make the risks of the anti-smoking drug Chantix known, reports the Dallas/FortWorth Local News. The lawsuit also claims that at the time their son was taking the drug the label did not contain adequate warning of the drug’s possible side effects.
According to allegations from the lawsuit, shortly after taking Chantix, in September 2007, Albrecht did not seem himself, the newspaper reports, and he became abusive, delusional and aggressive. After hitting his girlfriend several times, he then ran out of the house and was shot and killed when he tried to break into a neighbor’s house. Friends and family say Albrecht was never violent and believe Chantix played a role in his death.

$3.5 Million Awarded in Texas Cancer Misdiagnosis
The Dallas Morning News reports one of the largest awards in Denton County, since tort law reform of 2003, has been awarded to the family of a woman who died from misdiagnosed cancer in 2004. The $3.5 million is expected to be reduced to $1.5 million due to civil law and will be divided among her husband, her two children, and her father.
In October, 2002, the 33-year-old woman was told by Highland Family Medical Center the marble sized lump on her head was a sebaceous cyst. The cyst was removed and was not sent to a lab for testing to confirm that it was a cyst.
When the cyst returned a year later, the woman saw another doctor but did not have it removed because she was pregnant. By January, 2004, the cyst had quadrupled in size and was diagnosed as a sarcoma. After vigorous treatment, she died on December 14, 2004, leaving a husband and two small children.
The medical malpractice suit was filed by the woman’s husband against the medical center, the doctor, and the physician’s assistant who removed the initial cyst.
