$4.4 Million Awarded to Family In Automobile Wrongful Death Case

A Utah 4th District Court jury has awarded the family of a man killed in a traffic accident in 2006 almost $4.4 million, reports The Salt Lake Tribune.

Due to state law caps on damages against the state and the victim’s share of the responsibility, the award will be reduced by almost $2 million.

The family of the Payson man sued the state Department of Transportation and a subcontractor for failing to post appropriate signs warning of traffic delays as they were working on the reconstruction of a bridge. The man was killed as he came over the crest of a hill and tried to swerve to miss the driver ahead of him who slammed on his brakes to avoid hitting cars stopped because of the bridge project. He crashed his vehicle and died 13 days later.

The jurors awarded almost $3 million for economic damages and $375,000 each for the man’s wife and three children.

$5.3 Million Awarded in Smoker’s Death

The Miami Herald reports a Broward County jury awarded a 92-year-old man over $5.3 million in his wrongful death lawsuit against Philip Morris, the cigarette maker. The man’s wife died in 1996 at the age of 63 from lung cancer after smoking two packs of Marlboros a day since she was 16-years-old.

A jury determined in an earlier phase of the trial cigarettes caused the woman’s death.
Her husband’s attorneys also claimed the cigarette companies “hooked” her when she was just a kid.

The couple watched television in 1994 as tobacco executives swore to Congress that cigarettes were not linked to cancer. The woman didn’t believe the executives and told
her husband to sue them if anything happened to her.

The Maine Morning Sentinel reports a judge has awarded a Readfield woman close to $1.5 million for injuries suffered in a 2006 auto accident.

The 85-year-old woman collided with the other car which was blocking her lane as the driver was backing his car into his driveway. Once she saw the car, it was too late to avoid the accident.

As a result of her injuries, the woman, once independent, now has to live in an assisted-living facility, the article states.

The woman sued the driver and his business after his automotive insurance paid to the limit of the policy and the business’s insurance denied liability.

Medical Malpractice Lawsuit Filed Over Stomach Surgery

According to the Temple Daily News Telegram (Texas), a 45-year-old woman is suing Scott & White Memorial Hospital for medical malpractice alleging negligence resulted in multiple surgeries and a lifelong debilitating condition.

The once active woman has been an inpatient for 740 days since her surgery, she alleges, and she maintains medical expenses have cost her over $2.5 million and could reach over $30 million throughout her life.

Due to abdominal adhesions, her primary care doctors had decided she should never have abdominal surgery unless absolutely necessary, according to her complaint. In 2007, doctors at Scott & White performed abdominal surgery, causing multiple injuries, and resulting in an infection in her blood, she all alleged, and she has since had at least 22 surgeries to repair the damages from that surgery.

Wrongful Death Case Settled In South Carolina

The estate of a 43-year-old man who died in 2005 has settled a wrongful death lawsuit against the county and the Emergency Medical Services for $47,500, just days before the case was to go to trial, reports the Greenville, SC News.

According to the lawsuit, the man suffered a seizure while on a downtown street and EMS was called. The complaint stated that, due to the effects of the seizure, the man was non-responsive when the paramedics arrived and they assaulted him by pushing and shoving him then roughly wrestled him to the ground. His head hit a vehicle’s bumper, causing him to lose consciousness and die.

The defendants denied the assault stating they had to restrain the 43-year-old then he became unresponsive and went into full cardiac arrest. They claimed he died “despite the best efforts of emergency personnel.”
