A former BP security guard who tripped and fell, breaking both feet, when walking out of a portable toilet four years ago has been awarded $743,000 for her injuries by a Galveston jury, according to Galveston County’s The Daily News.

In 2005, the guard tripped outside the toilet near the BP chemical docks on a grate that she alleged was not installed properly. The woman alleged she suffered a permanent disability due to the accident and can no longer work as a security guard and is now driving a school bus.

Asbestos Emergency Declared in Libby, Montana

According to the Environment News Service, the first public health emergency ever declared by the U.S. Environmental Protection Agency exists in Libby, Montana. Vermiculite which was contaminated with asbestos was mined in Libby until 1990.

The EPA will not evacuate the town of 2,600, but will require an extensive cleanup and better health protection for residents with asbestos-related illnesses. The agency has asked for immediate federal attention and up to $130 million more for cleanup and medical costs.

There have been hundreds of asbestos-related disease cases in the small towns of Libby and Troy. Investigators from the federal Agency for Toxic Substance and Disease Registry found instances of asbestosis, a lung condition, “staggeringly higher” in this area than the national average for the period from 1979-1998. During this same period, the ATSD found the mortality in Libby resulting from asbestosis was 40 to 60 times higher than expected. Mesothelioma deaths were also higher.

$80 Million Settlement In Hurricane Rita Bus Fire Lawsuit

The Houston Chronicle reports an $80 million settlement for the families of 23 Bellaire nursing home residents who died in a bus fire while evacuating from Hurricane Rita in September 2005.

Sunrise Senior Living Services of McLean, Va., owners of Bellaire, ordered evacuation of the facility to a sister facility in Dallas the week before Hurricane Rita. While in route to Dallas, the bus caught fire and the 23 residents died, The National Highway Traffic Safety Administration later determined the probable cause of the fire was insufficient lubrication of a rear axle. The axle overheated, causing a fire which quickly filled the bus with flames and heavy smoke.

The settlement includes an agreement to end a lawsuit against the nursing home’s corporate owner.

$225,000 Paid In Taser Wrongful Death Lawsuit

The Coloradoan reports Larimer County commissioners have agreed to pay $225,000 to the estate of a man who died after being tasered repeatedly by sheriff’s deputies.

The man died October 25, 2005, almost three weeks after his heart stopped while being arrested by deputies. The man stopped breathing during the arrest and was taken to the hospital. But he never regained consciousness. The death was ruled a homicide.

The lawsuit claimed the deputies were not properly trained in the use of stun guns. During their depositions, the deputies stated they were not familiar with a memo from TASER International, manufacturer of the stun guns, warning against using a taser on a person in a state of “excited delirium” which came out three months prior to the incident.

$900,000 Settlement in Tiger Attack

The local CBS news channel in San Francisco reports the San Francisco Zoo has reached a $900,000 lawsuit settlement with two brothers who survived an attack by an escaped tiger on Christmas Day, 2007. The tiger killed their friend.

The 250-pound Siberian tiger jumped from its enclosure, mauled a 17-year-old to death and attacked the brothers. The tiger was shot and killed by police.

A lawsuit was brought against the San Francisco Zoological Society, the city of San Francisco, and a zoo spokesman last November. The lawsuit alleged the zoo had been negligent.

The family of the deceased boy has also reached a settlement with the zoo for an undisclosed amount.
