Woman Settles Flesh-Eating-Bacteria Medical Malpractice Lawsuit

The Orlando Sentinel reports a woman who ended up having both arms and legs amputated, allegedly due to a flesh-eating-bacteria, has settled her lawsuit against the hospital for an undisclosed amount.

After delivering a son at the Orlando Regional Healthcare System, Inc. (now called Orlando Health) in 2005, the woman developed a rash, fever, chills and other symptoms. The next day, even though she was in extreme pain the hospital tried to discharge her, according to her lawsuit, but her husband refused to take her home, and the following day surgery revealed she had gangrene in her belly.

Her condition grew worse and it was determined her body was being ravaged by Group A Streptococcal infection – a flesh eating bacteria. In hopes of saving her life, health care personnel amputated all four of her limbs. She is now confined to a motorized wheelchair.

Car Accident Victim’s Lawsuit Award Is Increased

A state appeals court has awarded $50,000 in additional damages to a 57-year-old accident victim, calling the lower court’s decision inadequate, reports the Albany, N.Y. Times Union.

In December 2000, the man lost control of his car on a snowy road and plunged into a ditch. He suffered traumatic brain injuries as a result of the accident and sued Schenectady County, which owned the road, for negligence.

The original award totaled $4.6 million, but the county filed to have the verdict tossed out, which was denied, but was successful in reducing the pain and suffering award. The appellate court found the lowered amount “inadequate” and awarded the victim the additional $50,000.

$1 Million Awarded In Medical Malpractice Death

A federal jury awarded almost $1 million to a 79-year-old Vermont resident’s family on May 15, ending a lawsuit filed in 2006 against Dartmouth-Hitchcock Medical Center.

The woman underwent coronary bypass surgery at the medical center in August 2005 and was readmitted two days later because she had difficulty breathing.

After determining the woman was suffering from low blood sugar, health care workers gave her IV doses of glucose after which her hand swelled, felt numb, and turned blue. Eventually she had two of her fingers and part of her hand amputated, after which she developed a serious bacterial infection. She died of a heart attack caused by the infection in November 2005.

The lawsuit alleged several instances of negligence against the medical staff at the medical center, including using the wrong type of IV line, and failing to recognize and properly treat the complications caused when the IV fluid leaked outside her veins.

Jailhouse Wrongful Death Lawsuit Settlted

According to The Associated Press, Santa Clara County in California has agreed to a $1 million settlement in a federal wrongful death lawsuit over the jail suicide of the former University of California, Berkeley student known as the “Naked Guy.”

The student’s mother accused officials of failing to prevent her son’s death. After being diagnosed with schizophrenia in 1997, he spent years in and out of jails and mental institutions. At the time of his death, he was jailed after getting into a fight at a halfway house. He was found in his cell with a plastic bag around his neck, just weeks after he tried to hang himself in his cell.

In her lawsuit, the mother alleged jail officials should have transferred her son to the mental-health wing after the first incident for his protection.

The former University of California, Berkeley became known nationally as “Naked Guy” in the early 1990s because he would show up for classes in the buff.

Nursing Home VP Charged in $40K Theft

The wife of the president of a Selinsgrove, PA nursing home is facing felony counts of theft after she allegedly stole $40,000 from three of the facilities residents, reports The Daily Sun.

The woman, who is believed to be the acting vice president of the Loving Care Nursing Facility, faces felony counts of theft by unlawful taking, theft by deception, theft by failure to make required disposition of funds, misapplication of entrusted property, and securing the execution of documents by deception, the paper reports.

The Snyder County District Attorney stated these charges are a culmination of several years of investigation.

Neurosurgeons Sued For Alleged Malpractice On Child’s Surgery

The parents of 5-year-old Katie have sued North Shore University Hospital and their star neurosurgeons for a spine operation that left the child unable to touch her toes, walk upstairs, and in constant pain.

The parents allege the surgery was unnecessary, reports the NY Daily News.

Before the surgery, which the surgeons claimed would help alleviate a rare brain defect known as Chiari Malformation, Katie was happy and active, riding her two wheeler and playing soccer, the parents alleged.

Katie’s parents are among at least four other families suing Doctors Thomas Milhorat and Paolo Bolognese for alleged unnecessary surgeries that inflicted further harm to the patients, according to the newspaper.

VT. Carbon Monoxide Wrongful Death/Personal Injury Lawsuit Settled

The Associated Press has announced the victims of carbon monoxide poisoning in Burlington, VT have settled out of court with the parties they named in their lawsuit.

Although not revealing the amount, the 23-year-old woman, who nearly died in the incident is said to be pleased with the settlement. The estate of her boyfriend, who died in the poisoning, also settled out of court.

In January 2005, carbon monoxide poisoning in the Redstone Apartments, which houses roughly 200 residents, killed one and sent nine others to the hospital. The investigation revealed a faulty boiler and a recalled pipe were to blame for the leak resulting in 40 times the normal level of carbon monoxide.

UVM students occupied most of the rooms of the apartment building, which did not have carbon monoxide detectors at the time of the incident.

Both families sued the building and maintenance companies of the Redstone Apartments and the installers of the heating boiler and pipe.
