USA Today reports a federal judge has upheld most of the $8.5 million he awarded in a medical misdiagnosis case. In 2002, a doctor at Scott Air Force Base, in southern Illinois, misdiagnosed the ex-wife of a captain when she came to him with a rash on her arm and he assumed she was an addict wanting prescription drugs.

The rash turned out to be a flesh eating bacteria. The woman lost the use of her arm and was awarded $8.5 million by a federal judge.

The government requested the award for damages be cut by over $1 million, but the judge let most of the original award stand and cut the damages by less than $63,000.

$23.7 Million Verdict for Fatal Truck Accident

After five years of litigation, a Will County, Ill., jury has awarded $23.7 million to three plaintiffs in what is thought to be the largest injury verdict ever awarded in the county, according to PRWeb.

On April 1, 2004, two men were killed and one seriously injured when the driver of a tractor trailer lost control and rear-ended several vehicles. The lawsuit was brought against the driver of the truck and the motor carrier, Toad L Dragonfly, both of whom admitted liability for the accident. The freight broker, C.H. Robinson, was also named in the lawsuit, but denied liability, stating the driver was an independent contractor.

Fall Through Trap Door Will Cost Restaurant $2.1 Million

In April 2001, a woman helping out the owners of the House of Corned Beef in Cleveland, Ohio plummeted 8 feet to her death after falling through a trap door on her way to the bathroom. Her husband filed a wrongful death lawsuit against the restaurant owners and has been awarded $2.1 million in the case reports Cleveland’s newspaper, The Plain Dealer.

The first judge threw out much of the lawsuit, stating the trap door was an “open and obvious hazard”. On appeal, the majority of the case was reinstated, saying “… businesses should maintain the premises in reasonably safe conditions.” Since the accident, a citation has been issued to the restaurant by Cleveland building inspectors calling the trap door, “a serious hazard that needed to be abated.”

The lawsuit alleged an oral surgeon extracted the 21-year-old’s wisdom teeth despite knowing he had an immunity disorder which precluded any surgery or other dental work. The young man had a swollen throat the next day as reaction to the surgery and later died of suffocation.

Supreme Court Rules Against Preemption

In the highly anticpated case of Wyeth vs. Levine, the Supreme court has ruled that federal law does not preempt a state’s ruling that the drug Phenergan was inadequately labeled. Past rulings, such as Riegel v. Medtronic had established that FDA decisions on drug safety preempted state rulings, effectively shielding drug manufacturers from pharmaceutical injury claims.

This ruling is being viewed as a win for drug injury victims as it may allow others who have been injured by prescription drugs a chance to seek compensation.
